The process of entertaining appeals up to disposal, adhering to principles of audit alteram partam.

In terms of provisions made in the Act of Administrative Tribunal No. 4 of 2002 any Public Officer / Police Officer / Audit Service Commission as the case may be, may prefer an appeal in writing under the signature of the officer concerned.

Such appeals shall be made in 05 (five) sets pf copies together with aggrieved decision and documentations related to the appeals within Four weeks from the date of the receipt of PSC/NPC/ASC decision as the case may be.

Such appeal can be submitted either by hand, post or through the Head of the respective Department.

Please note that when preferring an appeal you are required to mention your either email address, phone number or both as well.

Immediately after receipt of formal appeal the respective officer will take action to register it numbering in subsequential order in the registry.

As such a formal appeal will be listed for calling under respective register and send notices to appellant to appear before the Tribunal having reserved a date for calling. At the same time the notice will be sent to the respective appellate body to submit their observations. At this juncture the Tribunal is compelled to give them reasonable time for their observations, enabling them to get relevant information from the respective Ministry of Head of the Department, pertaining to the appeals, maintain by them being the appointing and disciplinary authority as well.

Note: In adequate documents pertaining to the appeal would cause initial delay in appeal process.

Hearing Stage

The process of hearing of appeals may take considerable time, because the cases are taken up for hearing in open session like conventional courts, in order to be hear the issues impartially adhering to principles of audi alteram partam.

After conclusion of oral submission at any stage either before or after hearing sufficient time will be given to submit written submissions.

Order

The decision/ order will be delivered in open session under the hand of the Chairman and Mebers as well

Such order / decision will be communicated in writing to the relevant parties such as Public Service Commission/ National Police Commission/ Aduit Service Commission/ Appellant and the parties notified by the Tribunal as the case may be.

The appeal process would take considerable time through the Section 7 of the Administrative Appeals Tribunal Act directs that an appeal shall conclude within two (02) months, because the Tribunal shall adhere to principles of audi alteram partam.

Further the two-months time period stipulated in section 7 of the Administrative Appeal Tribunals Act No 4 of 2002 for disposal of appeals in merely directory, and not mandatory as interpreted by the Supreme Court in several judgments in relation to similar provisions in other legislation. Issuance of certified copies

The certified copies of documents related to the appeals maintain by the Tribunal issued subject to cost on the request in writing.

Miscellaneous petitions

Informal appeals will not be accepted for calling and lay by as miscellaneous matters.
